1. Acceptance of Terms

These Terms of Use ("Terms") govern your access to and use of Echo of Love, including our website, applications, and related services (collectively, the "Service").

By creating an account or using the Service, you agree to be legally bound by these Terms. If you do not agree, you may not use the Service.

2. Description of the Service

Echo of Love is a digital content platform that allows users to:

  • Record and store text, audio, video, and photos
  • Generate digital biographies
  • Invite others to contribute memories
  • Designate trustees for post-death content release
  • Schedule messages for future delivery

The Service is intended for personal storytelling and digital legacy preservation. It is not a legal estate planning service.

We may modify or update features at any time without prior notice.

3. Eligibility

You must be at least 18 years old to use the Service. By using Echo of Love, you represent and warrant that you meet this requirement.

4. Account Registration & Security

You are responsible for:

  • Maintaining the confidentiality of your credentials
  • All activities under your account
  • Providing accurate and current information

We are not liable for unauthorized access resulting from your failure to secure your credentials.

5. User Content & License

Ownership

You retain ownership of all content you upload ("User Content").

License to Echo of Love

You grant Echo of Love a limited, non-exclusive, worldwide license to:

  • Store
  • Host
  • Process
  • Format
  • Generate biography content
  • Transmit and deliver scheduled content

This license exists solely to operate and provide the Service.

You represent that you have all rights necessary to upload your content.

6. Prohibited Conduct

You may not use the Service to:

  • Violate any law
  • Infringe intellectual property rights
  • Upload defamatory, abusive, or unlawful material
  • Impersonate another person
  • Violate privacy rights

We may remove content or suspend accounts at our sole discretion.

7. Trustees & Post-Death Release

Echo of Love allows you to designate trustees to request release of content upon your death.

You acknowledge and agree:

  • We rely solely on trustee confirmations.
  • We do not independently verify death.
  • We are not responsible for disputes among trustees or family members.
  • Once content release is triggered and executed, it cannot be reversed.
  • We are not liable for emotional, relational, or reputational consequences of released content.

You are solely responsible for selecting trustworthy individuals.

8. Invitations & Third-Party Submissions

You represent that you have permission to send invitations.

Echo of Love is not responsible for third-party submissions and does not verify their accuracy.

9. Subscriptions & Payment

Paid plans are billed monthly or annually.

By subscribing, you authorize recurring charges.

We may change pricing with reasonable notice.

Failure to pay may result in suspension or deletion of content.

All payments are non-refundable except where required by law.

10. Data Retention & Deletion

If your subscription expires:

  • Data will be retained for up to 12 months.
  • After that period, it may be permanently deleted without further notice.

We do not guarantee perpetual storage.

You are responsible for downloading backups if desired.

11. Service Availability

We do not guarantee:

  • Continuous operation
  • Error-free performance
  • Permanent availability

We may suspend or discontinue the Service at any time.

12. AI-Generated Content

AI features may assist with biography generation, avatar creation, or text enhancement.

AI-generated content may contain inaccuracies. You are responsible for reviewing and editing all outputs.

AI outputs do not constitute legal, financial, or professional advice.

13. Intellectual Property

All platform software, branding, and design are owned by Echo of Love.

You may not copy, modify, reverse engineer, or exploit the Service without written permission.

14. Digital Asset & Estate Disclaimer

Echo of Love:

  • Is not a will, trust, or estate planning instrument
  • Does not act as executor or fiduciary
  • Does not guarantee legal recognition of digital transfers
  • Does not determine lawful ownership of digital assets

Content stored on the platform does not automatically constitute legally binding instructions unless incorporated into a valid legal document.

Users are responsible for coordinating digital legacy wishes with licensed estate planning professionals.

15. No Fiduciary Relationship

Your use of the Service does not create a fiduciary, trustee-beneficiary, or legal advisory relationship.

We act solely as a technology service provider.

16. Limitation of Liability

To the fullest extent permitted by law:

Echo of Love shall not be liable for:

  • Emotional distress
  • Family disputes
  • Trustee misuse
  • Data loss
  • Service interruption
  • Indirect, incidental, consequential, or punitive damages

Our total aggregate liability shall not exceed the total amount you paid in the 12 months preceding the claim.

Some jurisdictions may not allow certain limitations.

17. Indemnification

You agree to indemnify and hold harmless Echo of Love from claims arising from:

  • Your User Content
  • Trustee disputes
  • Violations of these Terms
  • Third-party claims related to content release

18. Mandatory Arbitration

Agreement to Arbitrate

Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.

Arbitration shall take place in Georgia, USA.

The arbitrator's decision shall be final and binding.

Waiver of Jury Trial

YOU AND ECHO OF LOVE WAIVE THE RIGHT TO A JURY TRIAL.

19. Class Action Waiver

All claims must be brought individually.

You agree not to participate in any class, collective, or representative action.

The arbitrator may not consolidate multiple users' claims.

If this provision is found unenforceable, arbitration shall still apply.

20. Governing Law

These Terms are governed by the laws of the State of Georgia, without regard to conflict of law principles.

21. Force Majeure

We are not liable for failure or delay caused by events beyond our reasonable control, including:

  • Natural disasters
  • Cyberattacks
  • Cloud infrastructure failure
  • Government action
  • Internet outages

22. Assignment

We may assign or transfer these Terms without restriction.

You may not assign your rights without our written consent.

23. Severability

If any provision is found unenforceable, the remaining provisions remain in effect.

24. Survival

Provisions relating to arbitration, liability limitations, indemnification, intellectual property, and digital estate disclaimers survive termination.

25. Electronic Communications

By using the Service, you consent to receive communications electronically, including agreements and notices.

26. SMS / Text Messaging Terms

These SMS Terms apply only if you separately opt in to receive text messages from Echo of Love. Opting in to SMS is optional and is requested independently, at the point where you provide a phone number, from your acceptance of these Terms of Use.

If you opt in, depending on how you use the Service you may receive:

  • Account and reminder messages, such as reminders about your My Future Self goals and other account-related notices, if you provide your own phone number
  • A one-time invitation message, if another user invites you to the Service by SMS on their behalf

Message frequency varies and messages may recur depending on your use of the Service.

Message and data rates may apply.

You may reply STOP at any time to stop receiving messages from that program, or reply HELP for help. You may also contact us at contact@myechooflove.com.

Carriers are not liable for delayed or undelivered messages.

We do not sell or share your phone number or SMS opt-in consent with third parties for their own marketing purposes. See our Privacy Policy for details on how we handle your information.

27. Changes to Terms

We may update these Terms at any time.

Continued use after updates constitutes acceptance.
